Short Term Rental Agreement

Terms and Conditions: This Short-Term Rental Agreement (the “Agreement”) is made by and between Realty E, LLC (“Host”, “us”, or “we”) and the user of the booking site or platform (“Guest”, “you”, or “your”), and is effective as of the date the request to book the listed property (“unit”, “place”, “home”) was submitted. This Agreement provides for a revocable occupancy right for you and any Authorized Occupants to use and occupy the unit to which this Agreement relates located in the address shown in the listing building identified at the time of booking. Said occupancy shall be for temporary accommodation and not for any business or commercial use, except that you may maintain a personal home office if permitted in the jurisdiction and if the home office use does not involve (i) people coming to the Home for business purposes, or (ii) selling goods or services from the Home. You shall not advertise the Home on Airbnb, Couchsurfing, Craigslist, VRBO, or any other home sharing, co-living, advertisement, or listing service. This Agreement grants a revocable occupancy right only. No leasehold interest or other interest in real estate is granted hereby. Recording of this Agreement with the applicable land records office is prohibited.

For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 

Any reservations are not finalized until payment has been received.

Default check-in time: after 4pm CT.

Default check-out time: before 11am CT.

Different check-in and check-out dates and times, if available, will be made by a fee.

Total rate: as agreed in the corresponding communication platform.

Location, address: as shown on the corresponding communication platform.

Condition of our place. Upon access conditions have been met, we shall grant you access to our place in its as-is, where-is condition; with standard housekeeping service performed on or prior to the Start Date and Time. Furnished with our furniture, fixtures and equipment (including basic kitchen appliances, bathroom necessities), with all house systems (e.g. – windows and doors), appliances, and electronics in good working condition, reasonable wear and tear excepted.

Utilities. We shall provide utilities such as electricity, water, gas if necessary for appliances, and internet via Wi-Fi. Free of additional charge as long as used reasonably.

Manager’s Right of Entry and Access. Subject to applicable law, we may enter our place at any time for the protection or preservation of the premises, in the case of an emergency, or if you unreasonably withhold consent. If you or any authorized guest is present, then repairers, servicers, contractors, pest control, our representatives, or other persons listed in our notice to you, may peacefully enter the place at reasonable times. If nobody is the place, then such persons may enter peacefully and at reasonable times provided: we provide you with notice in the corresponding communication service (or chat window) 12 hours prior, or as agreed if you requested the corresponding estimate, repair, service, or any other reason.

Maintenance and Repairs. We shall be responsible for and pay for any maintenance and repairs, unless malfunction was caused by the guests, purposely or by negligence. You shall report any maintenance or repair issues only to us and through us and not to Building Management. You shall not paint, decorate or otherwise embellish and/or perform or cause to be performed any interior or exterior improvements or alterations to the Home (the “Home Alterations”) without the prior written consent of us, to be granted or withheld in our sole discretion. Any approved Home Alterations made by you must be removed by you, at your expense, on or prior to the Termination Date, provided that you repair any resulting damage to the Home and restore the Home to the same condition as when your accessed it at the beginning your reservation.

Cleanliness. You shall maintain our place in a clean condition. For stays longer than 3 to 4 weeks, we will require our cleaners to do a light clean up about every 3 weeks, usually 1 hr, at $30 per hour, paid to us by the guest. More often – or less – depending on their report on the condition of our place. This shall include bathroom cleaning, linen swap, and sweep and mop.

Keys and Locks. You acknowledge and agree that the locks or access code for the unit shall not be changed, altered, or replaced, and you shall not add new locks to our place. You will access the unit using an access code that will be sent to you. Upon expiration or earlier termination of the Reservation, the access code will be deactivated. Delivery of the code does not constitute surrender of the Home.

Early Termination. You might get a refund for the unused nights if you cancel the reservation to release the calendar and another traveler books those nights. Subject to a report by our staff on the conditions you left our place.

Extension. Subject to availability. Fees and nightly prices might differ from those of the original reservation.

Assignment, Subletting, and Transfer. You shall have no right to assign, sublet, license, or otherwise transfer or delegate this Agreement. Any assignment, subletting, licensing or transfer (whether by your voluntary act, operation of law, or otherwise) by you will be void, and we may elect to treat it as a non-curable breach of this Agreement. We may at any time assign, encumber, delegate, or transfer, in whole or in part, without restriction, our interest in this Agreement, and you must look solely to our transferee for performance of our obligations

relating to the period after the transfer. Your obligations under this Agreement will not otherwise be affected by any transfer.

Cancellation Policy: As agreed in the corresponding communication service.

HOUSE RULES:

Please read carefully before booking, because you will be required to comply with these House Rules.

★ ★ ★ No parties or gatherings of any kind. Additional animal fees might apply (see the section below for details).

★Upon booking, you will be required to submit in the communication service an unredacted picture of a GOVERNMENT-ISSUED ID (driver’s license, state ID, or passport) of every adult that will be present in the premises, including common areas and parking spaces. This is a NON-negotiable REQUIREMENT and MUST BE COMPLETED PRIOR TO ARRIVAL, IN ORDER TO GAIN ACCESS TO THE UNIT. We do not have a copy of your id when you uploaded it to any Online Travel Agency, so please upload it as well.

★Do not have more guests than stated in your reservation, and no unapproved visitors.

★Visitors present in the unit during quiet hours (as defined in these rules), are considered guests who must pay the corresponding fee.

★No smoking, vaping, or use of marijuana or illegal drugs at any time anywhere in the property.

★Quiet hours are between 10 pm and 7 am on weekdays, and from 11 pm to 10 am during weekends and local and federal holidays. Be respectful of neighbors by abiding to this quiet hours policy.

★We are not responsible or liable for any accidents, injuries, or illnesses that occur while on the premises.

★ALWAYS lock the front door, back door, and any other access point in general. We want you and all your belongings to remain SAFE.

★We are not responsible for the loss of personal belongings or valuables during your stay. We cannot be responsible for any items left behind. We might, upon negotiating reasonable fees, make arrangements to ship items left behind or to dispose of them, as appropriate.

★ Only use make-up towels (black small towels) to remove make-up.

★ Be respectful and mindful of the use of towels, stained or damaged towels will incur charges. (See the section on Room Fees at the bottom).

★No mail/packages/parcel delivery allowed.

★The animal fee already included in the price shown at booking is for one animal, as follows: 1 cat, or 1 small dog. Any additional animals, and/or any other animal, may be negotiated for an additional fee, to be paid upfront via a fee sent through the agreed payment platform or service before entering our place. Usually, $100 per additional animal, $25 on top if it’s a mid-sized dog, and $50 on top if it’s a large dog.

★ House-broken animals only. Animals other than dogs and cats must remain in their protected environment (fishbowl, cage, etc., as applicable).

★ Animals are not allowed on furniture and are not to be left unattended in our place.

★ Animals must remain quiet for the duration of their stay.

★ You will be charged for any lost or deceased animal found on the property including but not limited to any loss of business, service expenses, and supplies used to remedy the situation.

★ For longer stays with animals, a walk-through will be arranged with cleaners or management every 2 weeks.

★ Guests are required to remove their animals’ hair, scales, feathers, skins, or any other integument, off the furniture, or we will impose a clean-up fee of $50 per occurrence.

★ When bringing animals, check-out time will be 1 hour earlier, to give our cleaners a little more time to get the unit ready for the next guests.

★ Raccoons, squirrels, and other critters roam the surrounding area, be careful, especially if you are bringing children, animals.

★ ★ Please be aware that bugs roam around the area, and, although we have professional pest control in place, sometimes bugs get near and even inside our unit. Consider this if you are overly sensitive to such things before you book.

★★OTHER FEES★★

★FEES: Lost TV remote control will result in a $100 Charge.

★FEES: Smoking of any kind will result in a $250 Charge.

★FEES: Unapproved late check-out fees: $40 for every 15 min after check-out time.

★FEES: $100 per animal left unattended in the unit, per occurrence.

★FEES: $50 per night per person for each person not stated in the number of guests in your reservation. Also applicable for individuals failing to submit their government-issued identification.

★FEES: Disabling, obstructing, or tampering in any way with any of the safety or security devices, will result in a $250 fee for each occurrence and cancellation of the remainder of your reservation without a refund.

★FEES: $50 every time noise level exceeds 75dB (80dB for larger units) for 10 minutes.

★FEES: $80 every time noise level exceeds 75dB (80dB for larger units) for 10 minutes during quiet hours.

★FEES: $250 if having a party. Also, immediate cancellation of the reservation.

★FEES: $300 if being disruptive to neighbors. Also, immediate cancellation of the reservation.

★Violation of any house rule will result in the cancellation of the remainder of your reservation without a refund. Also, you waive the right to leave a review if you break any of the house rules. The following is subject to availability and can change before you have the time to respond.

Other considerations.-

Housekeeping: While linens, bath towels and hand towels are included in the unit, maid service is not included in the rental rate. We do not permit bath towels or linens to be taken from the units.

We recommend you to consider buying travel insurance. Read about it and make a decision while completing your booking. It might come handy if you have to cancel your reservation.

Post mail or parcel deliveries are STRICTLY prohibited. We encourage you to direct your mail and parcels to the nearest USPS office or parcel company. We will NOT be able to deliver any packages or mail you might receive.

We have cameras at entry points, aiming outwards, and no livable space is monitored or recorded. We respect your privacy.

We have noise-level monitoring in place. No audio or conversations are monitored or recorded, only noise levels. We will be alerted if the noise level exceeds 75dB (80dB for larger units), and your reservation might be voided and you will be asked to leave immediately.

You will need to climb stairs up or down in order to access some of our listings, and some also inside the place. Please consider this if you or any of your guests have difficulties with stairs.

Some of our listings are located near water bodies, where wild life is abundant. Bugs roam the area, and, although we have professional pest control in place, sometimes bugs get near and even inside our unit. Consider this if you are overly sensitive to such thing before you book. Also, raccoons, squirrels, and other critters might roam the surrounding area, pay attention especially when bringing small kids and animals.

Our place might not be suitable for travelers with a deficient immune system, allergic to household cleaning products, or with emotional conditions. We cannot be responsible for situations outside our place, with neighbors, other travelers, or your own guests.

We will be happy to assist with any questions you might have and to provide tips and recommendations for the surrounding area, and you will not be disturbed by us unless strictly necessary. We won’t be available in person, and prefer communicating through the app. If there are any problems or situation that arise, we ask you to let us know, and we will do our best to attend to these situations ASAP!

Manager’s closet is not available to guests.

For the convenience of our guests, we provide a starter set of consumables such as shampoo, body wash, toilet paper, paper towels, napkins, coffee, etc. If yours is an extended stay and should you need more of any of those products, we will be glad to provide them at a runner’s fee of $30/hr, 1hr minimum in increments of 1hr, plus the cost of the supplies, paid by the guest to us; subject to availability of both runner and supplies.

**Important** We are committed to protecting our properties, neighbors, and guests, which is why we’ve partnered with ‘Know-Your-Guest’, by superHOG, the leading vacation rental guest-screening provider. Please note that before your booking begins, you and all your adult guests will need to verify your details through Know-Your-Guest.

During such verification, you will be presented with 2 options: to pay a $50 non-refundable waiver fee, or to make a potentially refundable deposit of $500. The purpose of either is to cover small damages up to $500.

1. Early Arrival fee after 2pm is $40.00.

2. Super Early Arrival fee after 12:30pm is $60.00.

Anything earlier than this will require the previous night to be included in the reservation.

1. Late Check-out fee until 12noon is $40.00.

2. Super Late Check-out fee until 1:30pm is $60.00.

Anything later than this will require the following night to be included in the reservation.

If you’d like to take advantage of any of these options, please let us know. We will send you a request via VRBO, and once paid, our cleaning staff schedule will be updated with the new check-in / check-out time. Again, only if available.

By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises.

DISPUTE RESOLUTION BY BINDING ARBITRATION. AGREEMENT TO ARBITRATE

This Dispute Resolution by Binding Arbitration section is referred to in this Agreement as Arbitration Agreement. You agree that any and all disputes or claims that have arisen or may arise between you and us shall be resolved exclusively through final and binding arbitration, rather than a court, in accordance with the terms of this Arbitration Agreement. Further, this Arbitration Agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies, and such agencies can, if the law allows, seek relief against us on your behalf. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND UIS ARE EACH, TO THE FULLEST EXTENT ALLOWED BY LAW, WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, YOUR RIGHTS WILL BE DETERMINED BY A NEUTRAL ARBITRATOR, NOT A JUDGE OR JURY. THE FEDERAL ARBITRATION ACT GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS ARBITRATION AGREEMENT.

Prohibition of Class and Representative Actions and Non-Individualized Relief.

YOU AND US AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIE ACTION OR PROCEEDING. UNLESS BOTH YOU AND US AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING, ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S), EXCEPT THAT YOU MAY PURSUE A CLAIM FOR AND THE ARBITRATOR MAY AWARD PUBLIC INJUNCTIVE RELIEF UNDER APPLICABLE LAW TO THE EXTENT REQUIRED FOR THE ENFORCEABILITY OF THIS PROVISION.

Proceeding with the booking makes this contract valid, no signatures are necessary due to the strictly electronic nature of the interaction before and during the booking.
